These Terms of Use (“Terms”) govern your use of our web pages located at https://lunacal.ai operated by Lunacal Private Limited.

Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages. Please read it here

Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at hi@lunacal.live so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

If you wish to purchase a product or service through the Service (“Purchase”), you may be required to provide certain details, such as your credit card number, expiration date, billing address, and shipping information.

You confirm and guarantee that: (i) you are legally authorized to use any credit card or payment method for any Purchase; and (ii) the information you provide is accurate, complete, and truthful.

We may use third-party services to process payments and complete Purchases. By submitting your details, you authorize us to share this information with these third parties as outlined in our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons such as product or service availability, pricing or description errors, issues with your order, or other circumstances.

We also reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

Certain features of the Service are billed on a subscription basis (“Subscription(s)”). You will be charged in advance on a recurring schedule (“Billing Cycle”). Billing cycles can be either monthly or annually, depending on the subscription plan you choose when purchasing a Subscription.

At the conclusion of each Billing Cycle, your Subscription will automatically renew under the same terms unless you cancel it or Lunacal.ai decides to cancel it. You can cancel your Subscription renewal either through your online account management page or by reaching out to the Lunacal.ai customer support team.

A valid payment method, such as a credit card or PayPal, is necessary to process your subscription payment. You must provide Lunacal.ai with accurate and complete billing details, including your full name, address, state, zip code, telephone number, and valid payment method information. By submitting this payment information, you authorize Lunacal.ai to charge all Subscription fees incurred through your account to the specified payment method.

If automatic billing fails for any reason, Lunacal.ai will send an electronic invoice indicating that you need to make the payment manually by a specified deadline, reflecting the full amount due for the billing period as noted on the invoice.

Lunacal.ai may, at its sole discretion, provide a Subscription with a free trial for a limited time (“Free Trial”).

You may need to enter your billing information to sign up for the Free Trial.

If you provide your billing details when registering for the Free Trial, you will not be charged by Lunacal.ai until the Free Trial expires. On the last day of the Free Trial period, unless you cancel your Subscription, you will be automatically billed for the applicable Subscription fees based on the type of Subscription you selected.

Lunacal.ai reserves the right to (i) modify the Terms of Use for the Free Trial offer or (ii) cancel the Free Trial offer at any time and without notice.

Lunacal.ai may, at its sole discretion and at any time, adjust Subscription fees for the Subscriptions. Any change in Subscription fees will take effect at the end of the current Billing Cycle.

Lunacal.ai will provide you with reasonable prior notice of any changes to Subscription fees, allowing you the opportunity to terminate your Subscription before the new fees go into effect.

Your continued use of the Service after the change in Subscription fees signifies your agreement to pay the updated Subscription fee amount.

Except when required by law, paid Subscription fees are non-refundable.

Our Service enables you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other materials (“Content”). You are responsible for the Content you post on or through the Service, including its legality, reliability, and appropriateness.

By posting Content on or through the Service, you represent and warrant that: (i) the Content is yours (you own it) and/or you have the right to use it and grant us the rights and license outlined in these Terms, and (ii) posting your Content on or through the Service does not infringe upon the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any individual or entity. We reserve the right to terminate the account of anyone found to be violating copyright.

You retain all rights to any Content you submit, post, or display on or through the Service, and you are responsible for protecting those rights. We assume no responsibility or liability for Content posted by you or any third party on or through the Service. However, by posting Content using the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You agree that this license includes the right for us to make your Content available to other users of the Service, who may also use your Content in accordance with these Terms.

Lunacal.ai reserves the right, but not the obligation, to monitor and edit all Content submitted by users. Additionally, Content found on or through this Service is the property of Lunacal.ai or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said Content, in whole or in part, for commercial purposes or personal gain without our express prior written consent.

You may use the Service solely for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• To exploit, harm, or attempt to exploit or harm minors in any way, including exposing them to inappropriate content.

• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, in our judgment, may harm or offend Lunacal.ai or users of the Service, or expose them to liability.

Additionally, you agree not to:

• Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party’s use, including their ability to participate in real-time activities through the Service.
• Utilize any robot, spider, or other automated device, process, or means to access the Service for any purpose, including monitoring or copying any material on the Service.
• Employ any manual process to monitor or copy any material on the Service or for any unauthorized purpose without our prior written consent.
• Use any device, software, or routine that disrupts the proper functioning of the Service.
• Introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful materials.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is hosted, or any server, computer, or database connected to the Service.
• Launch a denial-of-service attack or a distributed denial-of-service attack against the Service.
• Take any action that may harm or misrepresent Lunacal.ai’s rating.
• Otherwise attempt to interfere with the proper operation of the Service.

We may engage third-party Service Providers to monitor and analyze the use of our Service.

Google Analytics is a web analytics service provided by Google that tracks and reports website traffic. Google utilizes the data collected to monitor and analyze the usage of our Service. This data is shared with other Google services. Google may also use the collected data to contextualize and personalize ads within its advertising network.

When you create an account with us, you affirm that you are over the age of 18, and that the information you provide is accurate, complete, and up to date at all times. Providing inaccurate, incomplete, or outdated information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to restricting access to your computer and/or account. You agree to take responsibility for all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately if you become aware of any security breach or unauthorized use of your account.

You acknowledge and agree that: (i) you will not retain, acquire, or assert any intellectual property right or other rights, title, or interest in or to the Feedback; (ii) Lunacal.ai may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential or proprietary information from you or any third party; and (iv) Lunacal.ai is not obligated to maintain confidentiality concerning the Feedback. If the transfer of ownership of the Feedback is not possible due to applicable mandatory laws, you grant Lunacal.ai and its affiliates an exclusive, transferable, irrevocable, free-of-charge, sub-licensable, unlimited, and perpetual right to use (including copying, modifying, creating derivative works, publishing, distributing, and commercializing) Feedback in any manner and for any purpose.

YOU EXPRESSLY AGREE THAT YOUR USE OF THESE SERVICES, THEIR CONTENT, AND ANY SERVICES OR ITEMS OBTAINED FROM US IS AT YOUR SOLE RISK.

NEITHER LUNACAL.AI NOR ANY PERSON ASSOCIATED WITH LUNACAL.AI MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SERVICES. We may terminate or suspend your account and restrict access to LUNACAL.AI immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of these Terms that by their nature should survive termination shall remain in effect, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will continue in effect. These Terms constitute the entire agreement between us regarding Lunacal.ai and supersede and replace any prior agreements we may have had regarding the Service.

We reserve the right to withdraw or amend Lunacal.ai and any services or materials provided through the Service at our sole discretion without notice. We will not be liable if, for any reason, all or part of the Service is unavailable at any time or for any period. Occasionally, we may restrict access to certain parts of the Service, or the entire Service, for users, including registered users.

We may modify these Terms at any time by posting the updated terms on this site. It is your responsibility to periodically review these Terms.

Your continued use of Lunacal.ai following the posting of revised Terms signifies your acceptance and agreement to the changes. You are expected to check this page regularly to stay informed of any updates, as they are binding on you.

By continuing to access or use our Service after any revisions take effect, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

If any provision of these Terms is determined by a court or other competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent necessary, ensuring that the remaining provisions of these Terms continue to remain in full force and effect.

BY USING THE SERVICE OR OTHER SERVICES PROVIDED BY LUNACAL.AI, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
